General: This website http://homesavingsofamerica.com (the “Site”) belongs to Home Savings of America. (“Company,” or “us,” or “our” or “we”).

We provide the materials on out Site as a service to brokers, which have entered into existing written Wholesale Origination Agreement with us. This page states the Terms and Conditions (the “Agreement”) under which you may use out Site. Only brokers who agree to be bound by these Terms and Conditions, you are not authorized to use this Site. If you do not accept these Terms and Conditions, you are not authorized to use this Site. The use of this Site constitutes your agreement to all such Terms and Conditions, all of which shall modify and supplement the most recent Wholesale
Origination Agreement you entered into with us.

These Terms and Conditions are supplementary to, not in place of, any written agreement between you and Home Savings, including but nor limited to, the Wholesale Origination Agreement. We may, in our sole discretion and at any time, modify the Site or specific portions of it and these Terms and Conditions by updating this posting. We may also discontinue the Site. You should visit this page periodically to review the Terms and Conditions, because they are binding on you.

Special rules may apply to the use of certain software and other items provided on this Site. Any such special rules will be listed as “Legal Notices” on this Site and are incorporated into this Agreement by reference.

PERSONAL USE LIMITATION: You may access this Site for the business for which it was intended. You may not copy, distribute, transmit, display, publish, reproduce, modify, transfer or sell any information obtained from this Site. Unauthorized access is prohibited. Unlawful or prohibited use of this Site will result in access being immediately terminated.

PROPRIETARY RIGHTS: All materials on this Site are owned by or licensed to Home Savings. No reproduction, transmission or distribution of Site materials in permitted without our written permission.

USER PASSWORDS NAMES: It is your responsibility to maintain the security and confidentially of any user name and password we issue you. It is your responsible to inform Home Savings if your email address changes so that confirmation of user name and passwords can be made. You agree that you will not permit unauthorized individuals to use your assigned user name and password to access this Site. You agree to indemnify and hold us harmless against any demands, claims, actions, losses, and expenses, including attorneys’ fees, arising out of or resulting from your failure to maintain the security and confidentiality of your assigned user name and password.

RATE LOCK APPROVAL: Home Savings will lock-in an interest rate and discount point combination (“Rate”) on a loan submitted through this Site based upon the information that you have supplied us through the Site or otherwise. If that information changes in any manner, or if we determine any of that information was fraudulent or incorrect, we reserve the right to cancel the Rate lock-in for the individual loan in question. Rate lock-ins are only valid for the original property, borrower and other specific characteristics for which the lock-in was submitted. If there is a change in the property, borrower or other specific characteristics, you must cancel the current lock-in and obtain a new lock – for the new loan at the current market rates. If you fail to cancel the lock-in we reserve the right to do so at any time. In order for a locked loan to fund the broker must be approved by Home Savings and be in good standing.

Home Savings of America is dedicated to responsible lending, and we are proud to support industry efforts to limit abusive, predatory, or unfair practices in the mortgage lending community. Our Responsible Lending Policy is the cornerstone of our commitment to eliminating these types of practices.

Responsible Lending Policy
We do not originate or purchase loans considered “High Cost” pursuant to the federal Home Ownership and Equity Protection Act of 1994 (HOEPA)—Commonly known as “Section 32” loans – or our pursuant to state, county. Or city “High Cost”, “Covered Loan”, or similar laws, however such laws or terms are labeled or referenced. Also, we so not originate or purchase loans considered “High Cost” or “High Risk” by the Federal National Mortgage Association (FNMA) in accordance with their Announcements 06-04 and 06-23.

We expect our wholesale brokers to exercise their fiduciary duty to the applicant to disclose all loan fees properly and to avoid steering the applicant into inappropriate loan programs. The broker is accountable for choosing the best loan program for the applicant, considering all of the applicant’s particular circumstances.

We adhere to individual government loan programs requirements that may have additional fee restrictions above and beyond legal limits.
